PURCHASE AGREEMENT

The purchase agreement is made with 110% Publishing.

The presentation of the products in the online store does not represent a legally binding offer but a non-binding online catalog. For technical reasons, the images of the products may differ in color from the originals. You will receive an email confirming the receipt of the order immediately after the order has been placed. However, this confirmation email does not constitute the acceptance of your order. This takes place in a separate email containing a delivery confirmation or upon delivery of the goods.

Should products be out of stock, unavailable, or sold out, the customer will be informed. If delivery is temporarily not possible, the order, if possible, will be reserved. In the case of sold-out products, the order will be canceled and refunded, unless a new print run is planned in the upcoming months. Then you may opt for keeping the order as a pre-order.

1. Delivery Conditions and Costs
In addition to the stated product prices, shipping fees may apply, which can be reviewed at checkout. For international deliveries, the customer is responsible for any additional taxes, customs fees, and import duties.

Shipping to Countries outside the European Union will be under Delivered at Place (DAP) terms and the customer is responsible for import duties, taxes, and customs clearance fees.

We only deliver by mail. Collection of goods is not possible.

2. Payment
The following payment methods are available in our store, depending on the country you are ordering from:

2.1. Credit Card
Your credit card will be charged as soon as the order is processed.

2.2. PayPal
You will pay the billing amount via the online provider, PayPal. You must already be registered there or sign up as a new customer, log in with your access data, and confirm the payment to us. You will be given further instructions at check out.

2.3. Klarna
You will pay the billing amount via the online provider, Klarna. You must already be registered there or sign up as a new customer, log in with your access data, and confirm the payment to us. You will be given further instructions at check out.

2.4. Apple Pay
You will pay the billing amount via the online provider, Apple Pay. You must already be registered there or sign up as a new customer, log in with your access data, and confirm the payment to us. You will be given further instructions at check out.

2.5. Shop Pay
You will pay the billing amount via the online provider, Shop Pay. You must already be registered there or sign up as a new customer, log in with your access data, and confirm the payment to us. You will be given further instructions at check out.

3. Pre-orders
You can pre-order items that have an expected shipment date in the coming months.

When purchasing a Pre-order, you will be among the first to reserve the item.

Estimated time frames are indicated on the product detail page and may be several months, potentially arriving sooner or later than estimated.

The purchase price will be deducted the same day that the order is placed.

Pre-order items will be shipped as soon as they are available.

If a Pre-order item can no longer be fulfilled, the amount paid will be refunded using the original payment method.

4. Damage During Shipping
Should articles be delivered with obvious shipping damage, please issue a complaint with the delivery service as soon as possible and contact us promptly. Failure to file a complaint or contact us has no consequences for your legal rights and their enforcement, particularly your warranty rights. They do, however, help us file our own claims against the shipping carrier and/or shipping insurance.

5. Warranty and Guarantees
Unless expressly agreed otherwise below, statutory warranty rights apply.

7. Liability
Our liability is limited to the value of the product. We do not assume liability for slightly negligent breaches of insignificant contractual obligations. The liability limitations mentioned above do not apply to attributable bodily injury, illness, or death.

8. Online Dispute Resolution
Online dispute resolution in accordance with ODR-VO art. 14, para. 1: The European Commission provides an internet platform for online dispute resolution (ODR), which you will find by following this link. We hereby declare that we are neither willing nor obliged to participate in dispute settlement proceedings before a consumer arbitration body.

9. Severability Clause
Should a provision of these General Terms and Conditions be or become invalid due to new statutory provisions, the remaining provisions shall remain valid. The parties agree to replace the invalid provision by a valid provision corresponding as far as possible with the economic meaning and purpose of the invalid provision.

Cancellation Policy

Right of Cancellation
You have the right to cancel this contract, without stating a reason, within 14 days.

The cancellation deadline is 14 days from the day you, or a third party appointed by you who is not the carrier, take possession of the last article.

The cancellation deadline is deemed observed if you send your declaration off before the deadline expiration.

Consequences of Cancellation
If you cancel this contract, we are required to promptly refund all payments (excluding shipping costs) we have received from you (with the exception of additional costs which are attributable to the fact that you selected a mode of delivery other than the least expensive standard shipping method we offer), within 14 days, at the latest, from the day we receive notice of your cancellation of this contract. This refund will be made with the same payment method you used in the original transaction unless it is expressly agreed with you otherwise. In no case will you be charged in connection with our refund. We are free to defer the refund until the articles have been returned to us or until you have provided us with proof that you have sent the articles to us, depending on which happens first.

You are required to promptly send the articles back to us no later than 14 days from the day you notify us of your cancellation of the contract. The deadline is deemed observed if you dispatch the articles before the end of this fourteen-day time limit. As soon as you have notified us of your cancellation, we will inform you how to return the article to us. You will only be liable for any loss of value of the articles if said loss is due to handling on your part beyond what is necessary to ascertain the nature, properties, and functioning of the articles.

For Returns in the United States and Canada
If the content of your order is incorrect, or arrives damaged, you are eligible for a full refund of the purchase price, including original shipping costs. If you received a damaged item, please contact us at thetype59book@gmail.com with details of the defect, including pictures if possible.

If you are unhappy with your purchase for any other reason, please note that you will be responsible for the return shipping cost, which is non-refundable. Upon receipt of your return, we will refund the full purchase amount of the returned items. Shipping fees are non-refundable.

To receive a refund, please return your item/s to us within 14 days of the delivery date and in the same condition you received it.

Please make sure to include the original packing slip so the return can be identified.
